#1
Student loans and other government loans cannot be discharged in bankruptcy. Student loans needs to be out of collections and in good standings in order to qualify for a mortgage loan.

Does it make a difference if it is a private student loan?

If the private student loan is guaranteed by Sallie Mae, it does matter. As long as any student loan is guaranteed directly or indirectly by the government, government student loan guidelines applies. If you just got a personal loan where you can do whatever you like and used it as a student loan, then it does not matter.
